Hiring a Foreign CTO or Tech Lead in Malaysia: Employment Pass Guide

Senior technical hires follow the same MDEC process, with the salary bands and succession planning mattering more.

Quick answer: A foreign CTO or tech lead can be hired on an Employment Pass through MDEC when the company is eligible and the person qualifies as a foreign knowledge worker, which includes professional, executive, management or technical roles in IT-enabled services. A basic salary of RM20,000 or more places the hire in Category 1, with a maximum contract of up to 60 months subject to MDEC's discretion. The company needs section 60K approval, a MyFutureJobs acknowledgement and approved projection headcount.

Key takeaways

  • Management and technical roles in IT-enabled services qualify as FKW roles.
  • Category 1 starts at RM20,000 basic salary, up to 60 months subject to MDEC discretion.
  • Section 60K, MyFutureJobs and projection headcount all apply.
  • MDEC encourages succession plan information now, with an annual declaration from 1 January 2027.
  • Whether the CTO also becomes a director or shareholder is a separate matter the MDEC pages reviewed do not cover.

Why Senior Roles Need Extra Care

Senior hires attract longer contracts, higher salaries and more attention to succession. MDEC's Category 1 contract can run up to 60 months subject to its discretion, while Immigration's revised policy FAQ says employment periods of up to 60 months may be requested. Succession planning matters most where one foreign hire leads a team, because the plan is meant to prepare local employees to take over the role within the employment period.

Salary and Category for Senior Roles

Category Minimum basic salary (MDEC) Maximum contract (MDEC)
Category 1 RM20,000 per month Up to 60 months, subject to MDEC discretion
Category 2 RM10,000 per month Up to 24 months
Category 3 RM5,000 to RM9,999 per month Not exceeding 12 months

The category table above is as MDEC publishes it on its Expats Service Centre pages. Immigration's revised salary policy applies to applications received on or after 1 June 2026 and its FAQ says companies may apply for employment periods of up to 60 months, without listing validity by category. The two sources do not match on duration, so confirm the period you can request with MDEC before you quote it in an offer letter.

Qualification

A CTO usually holds a bachelor's degree or higher, which qualifies under the first limb. Without a degree, a professional, executive, management or technical role in IT-enabled services qualifies under the third limb. The Employment Pass is a contract of service with the Malaysian company, so a CTO engaged as a consultant or through another entity is a different arrangement that needs advice before you proceed.

What MDEC Will Look At

  • Fit between the role and the company's approved activities.
  • Basic salary against the category minimum, excluding allowances.
  • Justification for any native or near-native language requirement.
  • Succession plan information, encouraged now and an annual declaration from 1 January 2027.
  • Whether the company meets its route's continuing conditions.

Hiring Steps

1

Company is registered with MDEC

MD companies subscribe through the Expats System. Non-MD ICT companies register and are assessed first. The company uploads the Authorised Person Letter and the Expatriate Service Agreement.

→
2

Obtain JTKSM section 60K approval

Apply through Xpats Gateway. Approval is valid for 12 months and one application covers several vacancies.

→
3

Advertise on MyFutureJobs

Obtain the PERKESO acknowledgement letter for the vacancy unless an exemption applies.

→
4

Submit the FKW Projection Request

File in the eXpats system with all mandatory documents. The FKW Approval Committee decides.

→
5

Submit the individual FKW application

File through Xpats Gateway with online payment. MDEC and Immigration approve or reject, and MDEC issues the letter.

→
6

Visa, endorsement and start

The applicant stays outside Malaysia until the Approval Letter is issued and any Reference Visa or eVisa is obtained. Endorsement at ESC KLIA Terminal 1 or at the Expats Service Centre follows.

Example: Planning a Founder-Level Hire

Example. A Malaysia Digital company recruits a CTO at RM25,000 basic. That sits in Category 1. The company files section 60K and MyFutureJobs first, includes the role in its projection, attaches succession plan information naming a local engineering manager and a two-year handover plan, and files the individual application after approval. The salary and plan are illustrative, not a prediction of approval.

Common Mistakes

⚠️

Counting stock options or allowances toward salary

Only basic salary counts.

⚠️

Assuming a title guarantees Category 1

Category follows basic salary.

⚠️

Treating a founder as an employee by default

If the person will own and run the company, MTEP or another structure may fit better. Ask first.

How We Help

What we handle for you

  • Prepare the JTKSM, MyFutureJobs and supporting documents with your team and review them against MDEC's checklist.

Application

  • Prepare the FKW projection and pass application for your company's authorised person to submit, and help you respond to MDEC and Immigration queries.

Frequently Asked Questions

Straight answers to the questions we hear most.

Who counts as a foreign knowledge worker?

On MDEC's MD route, a foreign knowledge worker holds a bachelor's degree in any field, or a diploma in multimedia or ICT, or a specialised ICT certification, with at least 2 years of relevant experience, or holds a professional, executive, management or technical role in IT-enabled services. On the non-MD route the experience requirement for diploma and certificate holders is 5 years. MDEC also lists exemptions for Global Business Services and Creative Content roles.

Is the minimum salary basic salary only?

Yes. Immigration's revised policy FAQ says the minimum salary is measured on basic salary only, and allowances and other payments are excluded. It applies to applications received on or after 1 June 2026. Complete applications received before that date are assessed under the previous policy.

What is a succession plan, and is it compulsory?

Immigration's FAQ describes it as a structured plan to prepare local employees to take over expatriate roles within the employment period, which may include role transfers, training, knowledge transfer and a timeline. MDEC's June 2026 announcement says companies are encouraged to submit succession plan information now, and that an annual succession plan declaration takes effect on 1 January 2027, as communicated by the Ministry of Home Affairs.

What is section 60K approval?

Section 60K of the Employment Act 1955 requires employers to get approval from the Department of Labour Peninsular Malaysia (JTKSM) before employing an expatriate. It applies to private sector employers in Peninsular Malaysia and Labuan under amendments effective 1 January 2023, applications go through Xpats Gateway from 1 July 2025, and it is required for new Employment Pass applications, valid for 12 months, and decided in 10 working days. Xpats Gateway states that operating without the required approval carries a fine of up to RM100,000, imprisonment of up to five years, or both.

Do we have to advertise the job on MyFutureJobs?

For new Employment Pass applications from 1 July 2025, Xpats Gateway requires the MyFutureJobs advertisement acknowledgement letter from PERKESO, with exemptions for renewals, in-country position or category changes, and positions on PERKESO's exemption list. PERKESO decides, and employers must follow its advertising guidelines. MDEC's pages describe this as SOCSO approval after advertising the vacancy.

What is an FKW Projection Request?

It is the request through the eXpats system for the number of foreign knowledge workers a company may hire. Under MDEC's June 2026 announcement, a company seeking new or additional FKW headcount files the request with all mandatory documents, MDEC reviews it, and the FKW Approval Committee decides. Only approved projection headcount allows the company to file individual FKW applications.

How long does an Employment Pass application through MDEC take?

MDEC states about 14 working days for an FKW Projection Request, about 7 working days for an individual FKW application, and 10 working days for the JTKSM section 60K approval that comes first. Endorsement takes 3 working days for an applicant already in Malaysia, and immediate endorsement at ESC KLIA Terminal 1 for an applicant arriving from abroad. A first-time MD company subscription takes about 2 working days, and a non-MD registration about 30 working days. These are stated service times for complete submissions, not guarantees.

What does an Employment Pass cost through MDEC?

MDEC's published charge is RM2,160 per applicant for an MD company and RM3,024 per applicant for a non-MD company, for new and renewal applications. A Dependant Pass or Social Visit Pass is RM540 per applicant, and an amendment of an approval letter is RM108. Immigration's own fees are on a separate Immigration schedule that MDEC links to, and this page does not quote them. Confirm the current amounts with MDEC before budgeting.

Can the foreign hire be in Malaysia when the application is approved?

For a new Employment Pass, MDEC states that the applicant must be outside Malaysia when the Approval Letter is issued. The applicant may enter Malaysia only after obtaining the Reference Visa or eVisa, if one is required for the applicant's nationality. Someone who needs a visa must obtain a Visa with Reference while abroad.

Can the employee bring family?

MDEC states that the spouse and children under 18 are eligible for a Dependant Pass, and unmarried children over 18, parents and parents-in-law are eligible for a Long-Term Social Visit Pass. MDEC's charge is RM540 per applicant for each. Immigration's revised policy FAQ adds that Category III Employment Pass applications submitted from 1 June 2026 are subject to the revised policy for dependants, while passes issued under the earlier policy stay under the old rule, which does not permit dependants.

Can the holder take a second job or move to another company?

MDEC states that the holder may not take other paid employment in Malaysia without Immigration's consent, and that the pass covers employment with the hiring company. A move to a new employer is therefore a fresh application by that employer. Immigration's revised policy says the employment period starts from the date of employment with the new company.

Can the CTO also be a director of the company?

The MDEC pages reviewed do not address directorship alongside an Employment Pass. Company law and Immigration conditions both matter, so confirm before appointing.

Does Category 1 need a higher paid-up capital?

MDEC's pages state paid-up capital only for non-MD companies, by ownership, and not by category.

Can the CTO sponsor family passes?

MDEC states the spouse and children under 18 may apply for a Dependant Pass, and parents and parents-in-law for a Long-Term Social Visit Pass, at RM540 per applicant.
