MD Status

Is Malaysia Digital Status Worth Applying For?

MD status is worth it when your plan already looks like what it requires.

Quick answer: Malaysia Digital (MD) status is worth applying for when your business already plans to do what it requires: carry out a qualifying technology activity in Malaysia, employ at least two full-time knowledge workers at RM5,000 average base salary, spend at least RM50,000 a year on the activity and report annually. In return you get access to the Bill of Guarantees, including exemption from local ownership requirements, foreign knowledge worker quota and a route to a tax incentive, which is a separate application. If your plan does not fit these commitments, the status adds cost without much benefit.

Key takeaways

  • Worth it if your plan already includes the hiring and spending MD status requires.
  • Not worth it if you would have to create commitments only to qualify.
  • The tax incentive is separate and has its own conditions.
  • Foreign ownership and foreign talent access are core benefits for overseas companies.
  • Run the test on your own numbers before applying.

The Trade

You commit to You gain access to
Two full-time knowledge workers at RM5,000 average base salary Foreign knowledge worker quota and passes
At least RM50,000 a year on MD activities Exemption from local ownership requirements
Carrying out the activity yourself in Malaysia A route to a tax incentive, by separate application
Annual declaration verified by an auditor Import duty and sales tax exemption on ICT equipment, subject to approval

A Five-Question Test

  • Does our core business fit an MD activity area?
  • Do we already plan two skilled hires on the activity?
  • Will we spend more than RM50,000 a year on it?
  • Do we need foreign talent or full foreign ownership?
  • Do we expect to qualify for and benefit from a tax incentive?

Who Usually Benefits

Profile Likely worth it?
Foreign-owned technology company building a team in Malaysia Often yes
Local product company with its own engineers Often yes
Start-up that cannot yet fund two hires Not yet
Reseller, agency or consultancy No, activities are excluded
Company wanting only a tax holiday Check the separate tax incentive criteria first

The Tax Incentive Caveat

MD status alone gives no tax exemption. MDEC's tax incentive for new investment offers a reduced tax rate or an investment tax allowance, but it requires MD status plus its own conditions, including minimum paid-up capital of RM50,000, and the applicant must not already have another Malaysian tax incentive for the same activity. Decide on the incentive separately.

⚠️

Ignoring reporting

Annual compliance is a real task.

Three Scenarios

Scenario 1. A foreign AI company plans six engineers in Malaysia. MD status fits its plan and removes ownership limits.

Scenario 2. A reseller wants MD status for prestige. Its activity is excluded.

Scenario 3. A solo founder cannot fund hires yet. It waits until the plan supports the conditions.
