Hiring Foreigners in Malaysia: A Guide for Tech Companies

The decisions to make, in order, before you offer a foreign hire a job in Malaysia.

Quick answer: A tech company in Malaysia can hire foreigners on Employment Passes through MDEC if it holds Malaysia Digital status and is in operation, or is an operating ICT company without MD status that meets the paid-up capital, office and assessment rules. The hire must qualify as a foreign knowledge worker, the basic salary must reach a category minimum from RM5,000, and the company needs JTKSM section 60K approval, a MyFutureJobs acknowledgement and an approved FKW projection.

Key takeaways

  • Choose the route first: MD status or non-MD ICT.
  • Hire only roles that fit MDEC's definition and the company's approved activities.
  • Budget MDEC charges of RM2,160 (MD) or RM3,024 (non-MD) per Employment Pass.
  • Plan weeks for section 60K, projection and application, not days.
  • Do not let the hire start work or enter before the pass and visa steps are done.

Decision 1: Which Route

MD status company Non-MD ICT company
Who it is for Company with MD (or MSC Malaysia) status that is in operation and complies with its conditions Malaysian-incorporated ICT company without MD status, fully operational, ICT as core business
Paid-up capital No amount stated on MDEC's MD page RM250,000 (100% local), RM350,000 (local and foreign), RM500,000 (100% foreign)
Office Not stated on MDEC's MD page; the company must be in operation Physical office in Malaysia required
First-time set-up About 2 working days About 30 working days, with site visit and possible interview
Employment Pass MDEC fee RM2,160 RM3,024
Diploma holder qualifies with 2 years' relevant multimedia or ICT experience 5 years' relevant experience

Decision 2: Which Role and Salary

Match the role to the FKW definition and the company's approved activities, then set a basic salary that reaches a category. Allowances do not count toward the minimum. MDEC's three bands are in the table.

Category Minimum basic salary (MDEC) Maximum contract (MDEC)
Category 1 RM20,000 per month Up to 60 months, subject to MDEC discretion
Category 2 RM10,000 per month Up to 24 months
Category 3 RM5,000 to RM9,999 per month Not exceeding 12 months

The category table above is as MDEC publishes it on its Expats Service Centre pages. Immigration's revised salary policy applies to applications received on or after 1 June 2026 and its FAQ says companies may apply for employment periods of up to 60 months, without listing validity by category. The two sources do not match on duration, so confirm the period you can request with MDEC before you quote it in an offer letter.

Decision 3: Cost and Timing

Item (per applicant, new and renewal) MD company Non-MD company
Employment Pass, MDEC charge RM2,160 RM3,024
Dependant Pass RM540 RM540
Social Visit Pass (parents, parents-in-law, children 18 to 25, common-law spouse) RM540 RM540
Amendment of approval letters RM108 RM108
Immigration fee Separate Immigration schedule Separate Immigration schedule
Step Stated time Route
Company subscription, first-time About 2 working days MD
Company registration and assessment, first-time About 30 working days (about 1 month) Non-MD
FKW Projection Request About 14 working days Both
FKW application approval About 7 working days Both
JTKSM section 60K approval 10 working days Both
Endorsement, applicant in Malaysia 3 working days Both
Pass renewal, applicant in Malaysia 3 working days Both

The Hiring Sequence

1

Company is registered with MDEC

MD companies subscribe through the Expats System. Non-MD ICT companies register and are assessed first. The company uploads the Authorised Person Letter and the Expatriate Service Agreement.

→
2

Obtain JTKSM section 60K approval

Apply through Xpats Gateway. Approval is valid for 12 months and one application covers several vacancies.

→
3

Advertise on MyFutureJobs

Obtain the PERKESO acknowledgement letter for the vacancy unless an exemption applies.

→
4

Submit the FKW Projection Request

File in the eXpats system with all mandatory documents. The FKW Approval Committee decides.

→
5

Submit the individual FKW application

File through Xpats Gateway with online payment. MDEC and Immigration approve or reject, and MDEC issues the letter.

→
6

Visa, endorsement and start

The applicant stays outside Malaysia until the Approval Letter is issued and any Reference Visa or eVisa is obtained. Endorsement at ESC KLIA Terminal 1 or at the Expats Service Centre follows.

Employer Duties That Continue

  • Keep meeting the route's eligibility conditions during the subscription and while passes are valid.
  • Avoid non-qualifying activities, which MDEC may check and act on by revoking passes or MD status.
  • Keep the Authorised Person Letter current when personnel change.
  • Plan succession: MDEC's announcement says an annual succession plan declaration takes effect on 1 January 2027.
  • Submit renewals through Xpats Gateway, up to three months before expiry under Immigration's revised policy FAQ.

Example: Offer Letter Timing

Example. A company wants a developer to start in three months. It checks the route, files section 60K, advertises on MyFutureJobs, files or confirms the projection, then files the individual application. It makes the offer conditional on Employment Pass approval and gives the start date as a target, because MDEC's times are for complete submissions and exclude queries and the hire's visa timing.

Common Mistakes

⚠️

Making an unconditional offer first

Approval is not guaranteed. Make the offer conditional on the Employment Pass.

⚠️

Hiring through a staff augmentation model

MDEC lists staff augmentation as a non-qualifying activity.

⚠️

Choosing a role outside the MD approval

The FKW's activities must match the approved activities.

How We Help

What we handle for you

Before you apply

  • Check which MDEC route your company fits, MD status or non-MD ICT, and whether the post, salary and category match.
  • Prepare the JTKSM, MyFutureJobs and supporting documents with your team and review them against MDEC's checklist.

Application

  • Prepare the FKW projection and pass application for your company's authorised person to submit, and help you respond to MDEC and Immigration queries.
  • MDEC states that companies are discouraged from nominating a third-party agent as the authorised person, so the submission stays under your own account.

Frequently Asked Questions

Straight answers to the questions we hear most.

Which companies can apply through MDEC?

MDEC's Expats Service Centre serves companies with Malaysia Digital (MD) status, or MSC Malaysia status, that are in operation and comply with the conditions of that status. It also serves ICT companies without MD status that are fully operational and use ICT as their core business, subject to a minimum paid-up capital, a physical office and an assessment by MDEC. Companies in non-qualifying activities, such as trading, staffing and staff augmentation, do not qualify.

Who counts as a foreign knowledge worker?

On MDEC's MD route, a foreign knowledge worker holds a bachelor's degree in any field, or a diploma in multimedia or ICT, or a specialised ICT certification, with at least 2 years of relevant experience, or holds a professional, executive, management or technical role in IT-enabled services. On the non-MD route the experience requirement for diploma and certificate holders is 5 years. MDEC also lists exemptions for Global Business Services and Creative Content roles.

What does an Employment Pass cost through MDEC?

MDEC's published charge is RM2,160 per applicant for an MD company and RM3,024 per applicant for a non-MD company, for new and renewal applications. A Dependant Pass or Social Visit Pass is RM540 per applicant, and an amendment of an approval letter is RM108. Immigration's own fees are on a separate Immigration schedule that MDEC links to, and this page does not quote them. Confirm the current amounts with MDEC before budgeting.

How long does an Employment Pass application through MDEC take?

MDEC states about 14 working days for an FKW Projection Request, about 7 working days for an individual FKW application, and 10 working days for the JTKSM section 60K approval that comes first. Endorsement takes 3 working days for an applicant already in Malaysia, and immediate endorsement at ESC KLIA Terminal 1 for an applicant arriving from abroad. A first-time MD company subscription takes about 2 working days, and a non-MD registration about 30 working days. These are stated service times for complete submissions, not guarantees.

What is section 60K approval?

Section 60K of the Employment Act 1955 requires employers to get approval from the Department of Labour Peninsular Malaysia (JTKSM) before employing an expatriate. It applies to private sector employers in Peninsular Malaysia and Labuan under amendments effective 1 January 2023, applications go through Xpats Gateway from 1 July 2025, and it is required for new Employment Pass applications, valid for 12 months, and decided in 10 working days. Xpats Gateway states that operating without the required approval carries a fine of up to RM100,000, imprisonment of up to five years, or both.

Do we have to advertise the job on MyFutureJobs?

For new Employment Pass applications from 1 July 2025, Xpats Gateway requires the MyFutureJobs advertisement acknowledgement letter from PERKESO, with exemptions for renewals, in-country position or category changes, and positions on PERKESO's exemption list. PERKESO decides, and employers must follow its advertising guidelines. MDEC's pages describe this as SOCSO approval after advertising the vacancy.

What is an FKW Projection Request?

It is the request through the eXpats system for the number of foreign knowledge workers a company may hire. Under MDEC's June 2026 announcement, a company seeking new or additional FKW headcount files the request with all mandatory documents, MDEC reviews it, and the FKW Approval Committee decides. Only approved projection headcount allows the company to file individual FKW applications.

Does staff augmentation qualify?

No. MDEC lists staff augmentation among the activities that do not qualify, describing it as resource requests through a request form, projects without project managers, pricing by resource tables or work permit costs, and resources with no service level commitment beyond available hours. MDEC states that it may check for these activities and revoke passes or MD status at any time.

Can we use a consultant or agent for the application?

MDEC states that companies are discouraged from nominating a third-party agent as the company's authorised person. The authorised person is named in the Authorised Person Letter on company letterhead and signs up through the company's own account. A consultant can still help prepare documents, check them against MDEC's checklist and advise on the route, while the company's own authorised person submits. Xpats Gateway separately says a Private Employment Agency may submit section 60K applications as an authorised representative, although its own wording on who counts as one is unclear.

Can the foreign hire be in Malaysia when the application is approved?

For a new Employment Pass, MDEC states that the applicant must be outside Malaysia when the Approval Letter is issued. The applicant may enter Malaysia only after obtaining the Reference Visa or eVisa, if one is required for the applicant's nationality. Someone who needs a visa must obtain a Visa with Reference while abroad.

Can the employee bring family?

MDEC states that the spouse and children under 18 are eligible for a Dependant Pass, and unmarried children over 18, parents and parents-in-law are eligible for a Long-Term Social Visit Pass. MDEC's charge is RM540 per applicant for each. Immigration's revised policy FAQ adds that Category III Employment Pass applications submitted from 1 June 2026 are subject to the revised policy for dependants, while passes issued under the earlier policy stay under the old rule, which does not permit dependants.

What is a succession plan, and is it compulsory?

Immigration's FAQ describes it as a structured plan to prepare local employees to take over expatriate roles within the employment period, which may include role transfers, training, knowledge transfer and a timeline. MDEC's June 2026 announcement says companies are encouraged to submit succession plan information now, and that an annual succession plan declaration takes effect on 1 January 2027, as communicated by the Ministry of Home Affairs.

Can any Sdn Bhd hire a foreigner?

Not through MDEC unless it fits MD status in operation or the non-MD ICT rules. Other companies use other routes, such as Immigration's ESD or MIDA. This page covers the MDEC routes for tech companies.
