Quick answer: Moving a staff member from an overseas office to Malaysia needs an Employment Pass applied for by the Malaysian company, because MDEC describes the pass as allowing work under a contract of service with a Malaysian organisation. The Malaysian company must be MDEC-eligible, the person must qualify as a foreign knowledge worker, the basic salary must reach a category, and section 60K, MyFutureJobs and projection headcount apply as for any new hire. The person must stay abroad until the Approval Letter is issued.
- The Malaysian entity applies and holds the contract of service.
- No separate intra-company transfer pass is described in MDEC's pages reviewed.
- Salary category is by basic salary paid for the Malaysian post.
- Approvals: section 60K, MyFutureJobs, projection.
- The person must be outside Malaysia when the Approval Letter is issued.
What Changes When You Move Someone
An overseas employee is on the overseas entity's payroll. To work in Malaysia on an Employment Pass, they need a contract of service with the Malaysian company, MDEC approval of the post, and Immigration's pass. The Malaysian company applies, pays the MDEC charge and holds the pass relationship. MDEC's pages reviewed describe no separate intra-company transfer pass.
Steps for a Transfer
Company is registered with MDEC
MD companies subscribe through the Expats System. Non-MD ICT companies register and are assessed first. The company uploads the Authorised Person Letter and the Expatriate Service Agreement.
Obtain JTKSM section 60K approval
Apply through Xpats Gateway. Approval is valid for 12 months and one application covers several vacancies.
Advertise on MyFutureJobs
Obtain the PERKESO acknowledgement letter for the vacancy unless an exemption applies.
Submit the FKW Projection Request
File in the eXpats system with all mandatory documents. The FKW Approval Committee decides.
Submit the individual FKW application
File through Xpats Gateway with online payment. MDEC and Immigration approve or reject, and MDEC issues the letter.
Visa, endorsement and start
The applicant stays outside Malaysia until the Approval Letter is issued and any Reference Visa or eVisa is obtained. Endorsement at ESC KLIA Terminal 1 or at the Expats Service Centre follows.
Contract, Salary and Category
Set the Malaysian basic salary first, because the category follows it and allowances are excluded.
| Category | Minimum basic salary (MDEC) | Maximum contract (MDEC) |
|---|---|---|
| Category 1 | RM20,000 per month | Up to 60 months, subject to MDEC discretion |
| Category 2 | RM10,000 per month | Up to 24 months |
| Category 3 | RM5,000 to RM9,999 per month | Not exceeding 12 months |
The category table above is as MDEC publishes it on its Expats Service Centre pages. Immigration's revised salary policy applies to applications received on or after 1 June 2026 and its FAQ says companies may apply for employment periods of up to 60 months, without listing validity by category. The two sources do not match on duration, so confirm the period you can request with MDEC before you quote it in an offer letter.
Short Assignments Are Different
A short stay without employment in Malaysia may fit Immigration's Professional Visit Pass rather than an Employment Pass. See our guide on Employment Pass vs PVP vs MDEC Expat Pass. Working under a social visit pass is not permitted, so do not start the person early.

Timing Checklist
- Confirm the Malaysian entity's route and status first.
- File section 60K and the MyFutureJobs step early.
- Include the role in the projection.
- Hold the move date until the Approval Letter and any Reference Visa or eVisa are issued.
- Pay online 5 working days before arrival and endorse 5 days before the flight.
- Plan dependants' passes together.
Example: Moving a Team Lead
Example. A Singapore parent moves a team lead to its Malaysian subsidiary at RM15,000 basic. That falls in Category 2. The subsidiary files section 60K, advertises on MyFutureJobs, includes the role in its projection and files the individual application. The team lead stays in Singapore until the Approval Letter is issued, obtains any visa needed, then enters Malaysia for endorsement at ESC KLIA Terminal 1.
Common Mistakes
Sending the person first
Applicants must be outside Malaysia when the Approval Letter is issued.
Keeping the overseas contract only
The Employment Pass needs a contract of service with the Malaysian company.
Skipping MyFutureJobs because it is a transfer
The exemptions listed do not include intra-group transfers.
How We Help
What we handle for you

- Prepare the JTKSM, MyFutureJobs and supporting documents with your team and review them against MDEC's checklist.
Application
- Prepare the FKW projection and pass application for your company's authorised person to submit, and help you respond to MDEC and Immigration queries.

Frequently Asked Questions
Straight answers to the questions we hear most.
Which companies can apply through MDEC?
MDEC's Expats Service Centre serves companies with Malaysia Digital (MD) status, or MSC Malaysia status, that are in operation and comply with the conditions of that status. It also serves ICT companies without MD status that are fully operational and use ICT as their core business, subject to a minimum paid-up capital, a physical office and an assessment by MDEC. Companies in non-qualifying activities, such as trading, staffing and staff augmentation, do not qualify.
Can the foreign hire be in Malaysia when the application is approved?
For a new Employment Pass, MDEC states that the applicant must be outside Malaysia when the Approval Letter is issued. The applicant may enter Malaysia only after obtaining the Reference Visa or eVisa, if one is required for the applicant's nationality. Someone who needs a visa must obtain a Visa with Reference while abroad.
What does an Employment Pass cost through MDEC?
MDEC's published charge is RM2,160 per applicant for an MD company and RM3,024 per applicant for a non-MD company, for new and renewal applications. A Dependant Pass or Social Visit Pass is RM540 per applicant, and an amendment of an approval letter is RM108. Immigration's own fees are on a separate Immigration schedule that MDEC links to, and this page does not quote them. Confirm the current amounts with MDEC before budgeting.
How long does an Employment Pass application through MDEC take?
MDEC states about 14 working days for an FKW Projection Request, about 7 working days for an individual FKW application, and 10 working days for the JTKSM section 60K approval that comes first. Endorsement takes 3 working days for an applicant already in Malaysia, and immediate endorsement at ESC KLIA Terminal 1 for an applicant arriving from abroad. A first-time MD company subscription takes about 2 working days, and a non-MD registration about 30 working days. These are stated service times for complete submissions, not guarantees.
What is section 60K approval?
Section 60K of the Employment Act 1955 requires employers to get approval from the Department of Labour Peninsular Malaysia (JTKSM) before employing an expatriate. It applies to private sector employers in Peninsular Malaysia and Labuan under amendments effective 1 January 2023, applications go through Xpats Gateway from 1 July 2025, and it is required for new Employment Pass applications, valid for 12 months, and decided in 10 working days. Xpats Gateway states that operating without the required approval carries a fine of up to RM100,000, imprisonment of up to five years, or both.
Do we have to advertise the job on MyFutureJobs?
For new Employment Pass applications from 1 July 2025, Xpats Gateway requires the MyFutureJobs advertisement acknowledgement letter from PERKESO, with exemptions for renewals, in-country position or category changes, and positions on PERKESO's exemption list. PERKESO decides, and employers must follow its advertising guidelines. MDEC's pages describe this as SOCSO approval after advertising the vacancy.
What is an FKW Projection Request?
It is the request through the eXpats system for the number of foreign knowledge workers a company may hire. Under MDEC's June 2026 announcement, a company seeking new or additional FKW headcount files the request with all mandatory documents, MDEC reviews it, and the FKW Approval Committee decides. Only approved projection headcount allows the company to file individual FKW applications.
Can the employee bring family?
MDEC states that the spouse and children under 18 are eligible for a Dependant Pass, and unmarried children over 18, parents and parents-in-law are eligible for a Long-Term Social Visit Pass. MDEC's charge is RM540 per applicant for each. Immigration's revised policy FAQ adds that Category III Employment Pass applications submitted from 1 June 2026 are subject to the revised policy for dependants, while passes issued under the earlier policy stay under the old rule, which does not permit dependants.
When can the employee start work?
MDEC's process ends with the pass sticker issued by Immigration, after which the applicant may start work. For an applicant abroad, the company pays online and clicks the endorse button 5 days before the entry or flight date, and the applicant presents the Approval Letter, the Reference Visa or eVisa if required, and the Confirmation Letter at ESC KLIA Terminal 1. Working before the pass is endorsed is not covered by any of these steps.
Can we use a consultant or agent for the application?
MDEC states that companies are discouraged from nominating a third-party agent as the company's authorised person. The authorised person is named in the Authorised Person Letter on company letterhead and signs up through the company's own account. A consultant can still help prepare documents, check them against MDEC's checklist and advise on the route, while the company's own authorised person submits. Xpats Gateway separately says a Private Employment Agency may submit section 60K applications as an authorised representative, although its own wording on who counts as one is unclear.
Is the minimum salary basic salary only?
Yes. Immigration's revised policy FAQ says the minimum salary is measured on basic salary only, and allowances and other payments are excluded. It applies to applications received on or after 1 June 2026. Complete applications received before that date are assessed under the previous policy.
Is there an intra-company transferee pass?
MDEC's pages reviewed describe none. The sources reviewed also do not describe an exemption for transfers from the MyFutureJobs or section 60K steps, so assume they apply unless MDEC confirms otherwise.
Can the person keep an overseas payroll?
The Employment Pass requires a contract of service with the Malaysian company. Payroll and tax arrangements need professional advice that this page does not give.
Does the overseas company need to register with MDEC?
No. The Malaysian company registers and applies. The overseas company is not the applicant.
